Rb. Rotterdam 6 juli 2022, ECLI:NL:RBROT:2022:5474
Summary in English below. Obligation to comply with new Dockers’ Clause, except in as far COVID-19 measures of IMO, EU of national government prohibit compliance. The clause is the result of the social dialogue between trade unions and seaferers’ employers’ organisations and serves the safety interests of seafarers. Falls within the Albany exception and therefore outside the scope of EU competition law. Asymmetry in the social dialogue does not alter this outcome. European rights and freedoms, tort against union, order restricted to EU ports, reinforced by a penalty in case of non-compliance.
