Rb. Rotterdam 13 januari 2016, ECLI:NL:RBROT:2016:596
Summary in English. Incidental proceedings on jurisdiction. A Croatian man (“G”) signs an employment contract (the Employment Contract) with International Bulk Reefers (“IBR”), a company with its statutory seat in Liberia, to work on board of the motor vessel “Orange Wave” as ‘second engineer’. IBR is the shipowner. The ship’s ‘vessel operator’ is the company Atlanship which is established under Swiss law. G boards the “Orange Wave” in Santos, Brazil. During his employment G is fired. He is allowed to remain on board of the “Orange Wave” until the ship arrives at the next harbour. On January 2012 the “Orange Wave” is sailing the waters off the coast of North Carolina (United States). During stormy weather G sustains a severe injury. While using the toilet, G grabs its doorpost with his left hand at which time the door slams shut. One finger of G’s left hand has to be amputated in an American hospital. G starts an action for damages against Atlanship and IBR before the District Court of Rotterdam in the Netherlands. According to G, the defendants have acted wrongfully by neglecting to install ‘technical facilities’ on board of the “Orange Wave” which would have ensured safe toilet visits during inclement weather. The 2007 Lugano Convention (Convention of 30 October 2007 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters). General jurisdiction concerning Atlanship. ‘Domicile’ ex Article 2(1) of the 2007 Lugano Convention. ‘Principal place of business’ ex Article 60. Special jurisdiction concerning Atlanship. Tort liability. Article 5(3). ‘Place where the harmful event occurred’. Discussion between the parties as to whether Rotterdam is the place of the event giving rise to the damage (the so-called Handlungsort). The fact that some employees of Atlanship in its branch office in Rotterdam are involved in the supervision of technical facilities on board of ships like the “Orange Wave” is not enough for the court of Rotterdam to have jurisdiction ex Article 5(3). There is neither jurisdiction on the basis of Article 5(5) of the 2007 Lugano Convention (disputes that arise out of the operations of the branch, agency or other establishment). Brussels Ibis Regulation (Regulation (EU) No 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters). General jurisdiction concerning IBR. ‘Domicile’ ex Article 4(1) of the Brussels Ibis Regulation. ‘Central administration’ ex Article 63. In the absence of any basis for jurisdiction the court has chosen not to rule on the question whether or not the arbitration clause in the Employment Contract applies in this case. Internationale bevoegdheid. Zuivering verstek. Bevoegdheidsincident.
