Rb. Rotterdam 2 december 2015, ECLI:NL:RBROT:2015:9785

Summary in English Decision on whether the Dutch court is bound, in proceedings between the insured and their liability insurers, by the facts established and conclusions drawn from those facts by The High Court of Justice in London in earlier proceedings between the insured and a third party holding them liable (in these English proceedings the insurers were not involved). Article 33 Brussels I Regulation (Council Regulation on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters). Article 26 Brussels Convention (Convention of 27 September 1968 on jurisdiction and the enforcement of judgments in civil and commercial matters). Extent of the authority and the legal effect of the judgment of The High Court of Justice to be determined in accordance with English law. Appraisal by the Rotterdam court of the evidence submitted by the insured to refute the prima facie evidence constituted by the English judgment. The insurance contract offers a wide coverage for damage ensuing from the liability of the insured toward third parties in connection with the activities of said insured as providers of logistics services. The risk that has materialised for the insured, however, is not a risk that is insurable (and therefore is not insured). There is, in the particular circumstances of this case, no connection between the normal business activities of the insured as described in the insurance policy and their intentional and furtive contributions to a slush fund to be used by their contractual counterparty.
